Terms of purchase

1. General

The following terms and conditions apply to agreements with SwedishHotTub AB, Org. 556986-2740, hereinafter referred to as “SwedishHotTub” or “We” and cover the purchase and delivery of goods to customers in Sweden and other countries where we deliver.

SwedishHotTub is headquartered in Gävle; you can visit us or send mail to Lunda byväg 4, 803 01 Gävle. You can also email us at info@swedishhotub.com.

SwedishHotTub sells hot tubs and terrace pools in its physical store in accordance with the Consumer Purchase Act (1990:932) or the Purchase Act for businesses. The terms below apply to store purchases except where specified exceptions apply, such as conditions for open purchases and returned goods.

SwedishHotTub also sells hot tubs and terrace pools through its online store at swedishhotub.com, in accordance with the Distance and Off-Premises Contracts Act (2005:59) as well as the Purchase Act for businesses. SwedishHotTub sells to both individuals and businesses.

SwedishHotTub also offers custom-made spa baths in various materials and designs. These custom-made products are addressed in a separate section of these terms and conditions.

SwedishHotTub reserves the right to update these purchase terms if necessary, without notifying the customer. We therefore recommend reading the terms before each purchase.

2. Prices

Prices are shown in the currency based on the specified delivery country, which is displayed on the website, and include VAT for orders shipped to recipients within the EU. The VAT amount is itemized on the order confirmation/receipt. We reserve the right to make price adjustments due to material costs, VAT changes, currency fluctuations, printing errors, price errors, delivery delays, etc., to the extent permitted by applicable consumer rights legislation.

3. Payment Responsibility

Placing an order via SwedishHotTub.com entails a payment obligation. By accepting our purchase and delivery terms at checkout, you agree to this payment responsibility.

4. Payment

On SwedishHotTub.com, you can pay using the following payment options:

  • PayPal
  • Invoice

Payment by Invoice

When ordering in our store or via our webshop, you can pay by invoice or PayPal. PayPal is the default payment method on the website.

Important to note when purchasing by invoice:

  • The invoice will be sent digitally to the email address you provided during ordering, not physically.
  • The invoice is sent in advance, and your hot tub is manufactured once payment is received.
  • The invoice is subsequently mailed, though you can change notification options if desired.
  • In some cases, we may send invoices within the Nordic region, in which case a credit check will be conducted.

In case of non-payment, a reminder fee of 60 SEK applies, along with a late payment interest of 22.00%. If payment is still not made, the claim may be referred for debt collection, which could incur additional collection costs.

8. Deliveries

Normal delivery times are listed on the website for the current period. During periods of high order volume, delivery times may be extended. We strive to get your order to you as quickly as possible. Once your hot tub is completed, you will be notified of the delivery. If your order is delayed for any reason, please contact our customer service.

Your order may need to be divided into multiple deliveries, meaning packages may arrive on different dates. The delivery notice will indicate if an item is back-ordered on the packing slip, with further deliveries expected, and you will receive a tracking number for each package.

Delivery to Pickup Point

Smaller packages are sent to a pickup point, where you will need to present ID when collecting your package. For accessory or spare parts purchases, a shipping fee is added and stated at the time of ordering.

Store Pickup

For purchases on our website, you have the option to pick up the item at our store. You need to present valid identification at pickup. If an agent collects the package on your behalf, they must show both your and their valid ID.

Home Delivery

All larger deliveries within Europe are made with Schenker or DHL. The goods are delivered to your property line or address boundary. Shipping costs are included for complete hot tub purchases. For accessories or spare parts, a shipping fee is added and stated at the time of ordering.

If you provided email and/or mobile information when ordering, you will receive tracking information as soon as Schenker/DHL has received your goods for delivery. With the tracking number, you can monitor your package status on Schenker’s or DHL’s website. If you have specific delivery requests, please contact our customer service, and we will try to accommodate them. Delivery occurs on weekdays between 07:00 and 17:00.

Upon delivery to your property line or address boundary, a tail lift is used for unloading. Packages are handled according to weight. You must present ID upon delivery.

Upon receiving the goods/package, inspect it for any transport damage. If damage is present, document it with the delivery agent, ensuring both parties sign the packing slip, and photograph it. See the section on transport damage below.

The following cases require goods to be left at a pickup point/terminal:

  1. If the driver deems the road inaccessible for larger vehicles.
  2. If you are unavailable at the delivery address during the scheduled delivery. If you are unavailable, a new delivery booking will be required, for which we will not cover the cost. A rebooking fee of 1,500 SEK will also be added.
  3. If an incorrect address is provided and it is outside the driver’s regular route. If within the route, a 300 SEK fee applies to change the address.

When goods are left at a pickup point, you will be notified and can collect them. Bring ID. If stored longer than five days at a pickup point or terminal, the shipping company charges storage fees based on size and duration, which will be invoiced to you as the customer.

SwedishHotTub does not cover any shipping costs other than those explicitly included with the order.

Missing Items

Check the packing slip to ensure all items have been included in the shipment. If anything is missing and is not back-ordered, contact customer service.

Business Deliveries

If you placed an order as a business, packages are shipped with Schenker/DHL to the company’s delivery address or pickup point, depending on package size. Delivery occurs on weekdays between 07:00 and 17:00.

10. Uncollected Packages

We reserve the right to charge the customer for packages or goods not collected from a pickup point or terminal that need to be returned. This fee covers return shipping, packing materials, handling fees, and administrative costs. This also applies if you are unavailable at the scheduled delivery. For questions about your package, please contact customer service for further assistance.

11. Transport Damage

Upon receiving goods or a package, the recipient must inspect them. If damage is present, document it with the pickup location or driver in the freight documentation signed by both parties, and take photos. Contact our customer service with the documentation and a description of the damage.

Damage that is not documented with the driver’s or pickup location’s signature on the freight documentation will not be compensated by the carrier or SwedishHotTub.

Report the damage to us within seven (7) days of receipt. Reports made later will not be compensated.

12. Right of Withdrawal

As a consumer, if you purchased your goods remotely (e.g., online), you have the right to withdraw from the agreement within 14 days without specifying any reason. The withdrawal period expires 14 days after the day you or a designated third party, not the carrier, physically takes possession of the goods. If you ordered multiple items in one order that are sent separately, the 14 days begin from when you or a designated third party, not the carrier, physically takes possession of the last item.

To exercise the right of withdrawal, send a clear and explicit message of your decision to withdraw. Email our customer service at info@swedishhotub.com.

To ensure your right to withdrawal is exercised in time, simply send your message before the withdrawal period expires.

Effect of Exercising the Right of Withdrawal

If you withdraw from the agreement with us, we will refund all payments received from you, including delivery costs (except for additional costs due to a delivery method other than the cheapest standard delivery we offer). The refund will occur without undue delay, no later than 14 days from the day we were informed of your decision to withdraw. We will issue a credit to your invoice unless you agree to an alternative. In any case, no fees will be charged for the refund. We may withhold the refund until we have received the returned item or until you provide proof of return, whichever occurs first. For more information on refunds, see point 14 below.

You should return the item to us or hand it over to our store in Gävle without undue delay and in any case within 14 days from the day you informed us of your decision to withdraw. For instructions on returning an item, see point 13 below. The withdrawal period is considered observed if you send back the goods before the 14-day period expires.

Return shipping is at the customer’s expense. You are only responsible for any reduced value of the goods due to handling other than what is necessary to determine the nature, characteristics, and functionality of the goods.

Exemptions from the Right of Withdrawal

The right of withdrawal does not apply to:

Goods that are custom-made according to your specifications or have a clear personal touch. This includes custom-made hot tubs built to your specified measurements and other custom features, such as our stainless steel tubs.
