1. About Swedish Hot Tubs AB
– The company has its registered office in Gävle. The company’s postal address is Lunda byväg 4.
– If you want to get in touch with us, send an email to info@swedishhottub.com with your case and your contact details and we will contact you shortly.

2. prices
– All our prices are stated in different currencies connected to different countries, VAT is included in all prices.

3. payment
– To make the payment as safe as possible for both parts, the payment is through PayPal.
– The products are sent to your registered address. 
– A reminder fee of SEK 50 and penalty interest of 22% is charged for late payment.

4. Shipping and delivery
– Our hot tubs are manufactured and distributed from our premises in Gävle. Here you can pick up your hot tub or have it delivered to your home with Schenker.
– Accessories are sent with Schenker and the cost depends on size and weight. If you order the products in our web shop, you will immediately see what the final cost will be.
– All delivery times we indicate are delivery times from the factory to the shipping company.

– If you enter the wrong address (e.g. wrong postal number), a correction fee will be added.

– If you are not available when unloading your order, you will be charged for the costs incurred for so-called boom driving. For packages delivered to the delivery point and not redeemed, you will be charged for shipping and return shipping.

– Terminal rent is charged if you cannot receive your home delivery within 8 days of notification. The size of the terminal rent depends on how many days it is left at schenker.

– Unloading at delivery takes place on weekdays between 07.00 and 17.00. Upon request, you must be able to identify yourself at the reception of the goods.

– Baths are unloaded with a tailgate lift to ground level directly adjacent to the vehicle. The bath is parked at the property line or as close to the property line as the carrier deems possible to drive the vehicle. If the road is not classified by the transport company as a passable road, it is the buyer’s responsibility to pick up the bath at the nearest freight terminal. Any transport costs incurred for this are the responsibility of the Buyer.

6. complaint
– Photograph the damage, both with and without packaging.
– Email the picture, order number and a detailed description of the complaint to: melinda@svenskabadtunnor.se.
– We will agree whether the product should be sent to us or whether the fault should be fixed on site.
– You are responsible for disassembling the product, packing it and sending it to us.
– Any shipping damage during return shipping is the customer’s responsibility if it is not approved by the shipping company.
– If the damage is covered by the warranty, you will receive a warranty authorization and a refund of the shipping costs.
– We will repair the item or send you a new one.
– You are responsible for installing the new or repaired product. We do not pay any installation costs.
– The product will be replaced or refunded once the return is approved.
– In the event of a suspected error on the product, it is important not to unscrew or try to repair the error without contacting us first as the warranty does not apply when this has happened. We are responsible for return shipping in case of approved complaints. We reserve the right to refuse a complaint if it turns out that the product is not defective in accordance with current consumer protection legislation. In case of complaints, we follow the guidelines of the General Complaints Board, see arn.se.

7. limitation of liability
– We do not take any responsibility for indirect or direct damages that may occur due to the product. We do not accept any responsibility for damage to the surrounding environment that any product failure/damage may cause. We do not accept any responsibility for delays/errors due to circumstances beyond the company’s control (Force Majeure). These circumstances can be, for example, labor conflict, fire, war, government decisions, reduced or no delivery from the supplier. Furthermore, no responsibility is taken for any changes to products/product characteristics that have been changed by the respective supplier and other factors beyond our control. Svenska badtunnor can never be held responsible for indirect damage such as e.g. downtime, lost profit or turnover or other indirect damage regardless of whether the Buyer has been negligent or not.

– We reserve the right for any printing errors on this website and the final sale of products. We do not guarantee that the images reproduce the exact appearance of the products as a certain color difference may occur depending on the monitor, photo quality and resolution. We always try our best to expose the products as accurately as possible.

9. Information about cookies
– According to the law on electronic information, visitors to a website for privacy purposes must be informed that cookies are used. The information in the cookie can be used to track a user’s browsing. A cookie is a small text file that the website you visit requests to save on your computer to provide access to various functions. You can set your browser to automatically reject cookies. 10. Personal data
– By shopping at Svenska Badtunnor AB, you accept our data protection policy and our processing of your personal data. We protect your personal integrity and do not collect more information than necessary to process your order. We never sell or pass on your data to third parties without a legal basis. Svenska Badtunnor AB is responsible for the processing of personal data that you have provided to us as a customer. Your personal data is processed by us to be able to handle your order and in cases where you have requested newsletters or promotional offers – in order to
adapt the marketing to your individual needs. The information below is a summary of how we store and process your data in accordance with the General Data Protection Regulation (GDPR).
10.1 What is personal data?
– Personal data is any information that can be directly or indirectly attributed to a natural person.
10.2 What data do we store?
– In order to handle your order and answer questions related to your order (customer service), we store your personal number, first and last name, address, telephone number, e-mail address, IP address and purchase history. Your data is stored as long as we have a legal basis to process your data, for example to fulfill the agreement between us or to comply with a legal obligation under, for example, the Accounting Act.
10.3 Legal basis
– In connection with a purchase, your personal data is processed to fulfill the agreement with you. Marketing, campaigns and similar mailings take place with your consent.
10.4 What data is shared and for what purpose?
10.4.1 Payment provider
– When making a purchase, information is shared with our payment provider. What is stored is first name, last name, address, e-mail address and telephone number. If you choose to pay by invoice, the social security number is also saved with the payment provider. The information is stored in order to complete the purchase and to protect the parties against fraud. The payment providers (payment services) that we use are: Invoice, Swish and partial payment and invoice via Svea Ekonomi.
10.4.2 Shipping companies- In order to deliver your orders and complete our contract, we need to share specific information with the shipping company. What is shared with the shipping company is first name, last name and delivery address details. Email address and/or mobile number may also be shared with the shipping company for notification purposes. The shipping companies we work with are: Schenker.
10.4.3 Newsletter
– If you have chosen to subscribe to our newsletter, your first name, last name and e-mail address will be shared with our newsletter provider. This is to keep you updated with information and offers for marketing purposes. We use for sending out newsletters.
10.5 Right of access
– You have the right to obtain extracts of all information held about you by us. Extracts are delivered electronically in a readable format.
10.6 Right to rectification
– You have the right to ask us to update inaccurate information or complete information that is incomplete.
10.7 Right to be forgotten
– You can ask for your data to be erased at any time. There are few exceptions to the right to erasure, such as if it must be retained in order for us to fulfill a legal obligation (e.g. under the Accounting Act).
10.8 Responsible for data protection
Svenska Badtunnor AB is responsible for the storage and processing of personal data in the online store and ensures compliance with the rules.
10.9 How we protect your personal data

– We use industry standards such as SSL/TLS and one-way hash algorithms to securely store, process and communicate sensitive information such as personal data and passwords. We use a Swedish platform, Askås, which is operated by Askås based in Säffle.

11. Changes to the General Terms and Conditions
– We reserve the right to make changes to the terms and conditions at any time. Changes to the terms and conditions will be published online on the website. The amended conditions are deemed to be accepted in connection with orders or visits to the website.

12. Dispute and law
– In the event that a dispute cannot be resolved in agreement with the company’s customer service and the customer, you as a customer can turn to the General Complaints Board, see arn.se. For residents of an EU country other than Sweden, complaints can be submitted online via the European Commission’s platform for mediation in disputes, see https://ec.europa.eu/consumers/odr.
In the event of a dispute, we follow the decision of ARN or a similar dispute resolution body. Disputes regarding the interpretation or application of these general terms and conditions shall be interpreted in accordance with Swedish law.

13. Our guarantees
– The Consumer Code gives you a one-year warranty and a three-year right to complain about any manufacturing defects.
– Because we manufacture the barrels ourselves, we know that they will last, provided they are used correctly and are not affected by external factors. Therefore, we can provide much more generous guarantees:
* Three-year warranty on polyethylene plastic inserts
* Two years warranty on stoves
* One year on wear and tear items such as lighting, gaskets and seals.

These guarantees are subject to you following our installation manuals and maintenance instructions. Save the invoice or the delivery note. They are both valid as warranty certificates.
You must always contact us for approval before returning a defective product. The complaint should be sent immediately after the defect has been discovered. The warranty expires if modifications are made to the product without prior written approval from Swedish Hot Tubs. The warranty is also not valid if repairs have been carried out with other than approved spare parts or if maintenance according to the instructions has not been carried out.

– No guarantees apply to the following:
* Chlorine use in the hot tubs (chlorine is approved for use in our electrically heated patio pools with plastic connections, it must be chlorine adapted to the hot tub and we take no responsibility for damage that may arise from overdosing/misuse of chlorine).

 

*Damage caused by poor water quality

* The electrical system must have adequate insulation. The temperature in the technology box must be maintained at 10 degrees or more. The temperature in the technology box must not deviate more than a few degrees from the water temperature. Hoses run outside the technology box to and from the bath must have at least equivalent insulation to the rest of the installation.

* Use of other than biocool as a disinfectant in baths with a stove or LPG heater, and also if you have aluminum connections in your bath.

* In case of ice formation in the hot tub
* Burning without sufficiently filling the hot tub with water.
*Damage to a product due to water freezing in/on it.

*Dry running of the pump

*Water in any of the electrical parts

* Emptying the hot tub before the stove has cooled down.

14. transportation damage

It is the Buyer’s responsibility to inspect the goods on receipt. If the Buyer discovers upon receipt that the shipment is damaged in transit, the Buyer must immediately point this out to the parcel agent or carrier. The damage must then be described in the shipping document. The document must be signed by both. Send an email to info@svenskabadtunnor.se with pictures and a description of what has happened.

If something is missing from your order and it is not noted as remaining on the delivery note, you should contact us immediately at info@swedishhottub.com.


All complaints about the delivery must be received by us within seven days of delivery. Errors pointed out after this will not be replaced by us at Swedish hot tubs or by the transport company.

You as a buyer approve the transportation and that there is no damage to the goods by signing the shipping document that the carrier has with him. If a shipping damage is discovered after receiving the goods and on the written transport is approved by you as a buyer, there is no right to compensation from Swedish hot tubs or the transport company.

15. Right of withdrawal
– All baths are always a special order that is customized. Nevertheless, we give you a right of withdrawal of 14 days after delivery.
15.1 When exercising your right of withdrawal: You must notify us of your withdrawal. The message should be sent to us at info@svenskabadtunnor.se. Your message must clearly state your name, address, e-mail address, order number and the goods to be returned. You must return the products to us immediately and at the latest within 14 days of the notice of withdrawal. You are responsible for return shipping, delivery and the condition of the products upon return, so the products should be sent well packaged and in their original packaging. The buyer is responsible for the return shipping. On the refund amount, we reserve the right to deduct a sum corresponding to the decrease in value compared to the original value of the product in case of used or damaged product. A deduction of SEK 3000 will be made on the refund if we have paid for the shipping of the bath to you. For baths sent outside Sweden, this amount may be higher. For crane truck freight, a higher amount will also be deducted if this freight is not paid by the customer.

15.2 In cases where the goods are built to very specific specifications indicated by the buyer, there is no right of withdrawal. The right of withdrawal shall in all cases lapse in its entirety when the Goods have been used beyond what is objectively reasonable to examine them and/or determine their nature. Such use may include, for example, assembly, filling with water, burning, etc.

15.3 The right of withdrawal exists only for individual consumers who buy the goods for their own private consumption. There is no right of withdrawal for traders, or if the purchase can be considered to be made with the aim of being used mainly within the framework of business activities.

16. in accordance with the terms of this purchase agreement, Svenska Badtunnor disclaims all liability for any direct or indirect damage to person, property or assets that may arise from their products or services, or from the buyer’s inability to use these products or services.

Buyer agrees to indemnify Swedish Hot Tubs and its employees, owners and agents against all claims, demands, losses, liabilities and expenses that may arise in connection with Buyer’s use of products and services, including products and services obtained through Buyer’s use of Swedish Hot Tubs’ products and services. Buyer shall also indemnify Swedish Hot Tubs for any claims, losses, liabilities and expenses that may arise from Buyer’s breach of any of the terms of this Agreement, Buyer’s use of Buyer’s personal information or Buyer’s violation of the rights of third parties, including third party suppliers.

By entering into this purchase agreement, Buyer agrees not to claim Swedish Hot Tubs for any damages, losses, liabilities or expenses that may arise from Buyer’s use of products and services or if Buyer breaches any of the terms of this agreement.
