Terms and Conditions

1. Om Svenska Badtunnor AB
– The company is headquartered in Gävle. The company’s postal address is Lunda byväg 4.

– If you wish to get in contact with us, please send an email to info@svenskabadtunnor.se with your inquiry and your contact details, and we will get back to you as soon as possible.

2. Prices
– All our prices are stated in Swedish kronor, including VAT. You will find them next to each individual product.

3. Payment
– There are various payment options: Swish, invoice with 10 days’ payment term (a simple credit check is carried out when paying by invoice), as well as interest-free instalment payments via Svea Ekonomi. Read more about the terms of Svea Ekonomi here.
– The products are shipped to your registered address. If delivery is to a different address, prepayment is required. For business purchases, prepayment is required.

4. Shipping and Delivery
– Our hot tubs are manufactured and distributed from our premises in Gävle. Here you can collect your hot tub yourself or have it delivered to your home with DB Schenker.
– Accessories are shipped with DB Schenker, and the cost depends on size and weight. If you order the products in our online store, you will see the final cost immediately.
– All delivery times we provide refer to dispatch times from the factory to the carrier.

– If you provide an incorrect address (for example, the wrong postal code), a correction fee of 300 SEK will apply.

– If you are not available when your order is delivered, you will be charged for any costs incurred due to a failed delivery attempt. For packages delivered to a pickup point that are not collected, you will be charged for both shipping and return shipping.

– Terminal storage fees will be charged if you are unable to receive the home delivery within 8 days after notification. The amount of the storage fee depends on how many days the shipment remains with DB Schenker.

– Delivery unloading takes place on weekdays between 07:00 and 17:00. You must be able to provide identification upon request when receiving the goods.

– Unloading of the hot tub is carried out using a tail lift to ground level directly at the vehicle. The hot tub is placed at the property boundary or as close to it as the carrier considers it possible to access. If the road is deemed inaccessible by the transport company, it is the buyer’s responsibility to collect the hot tub from the nearest freight terminal. Any transport costs incurred in connection with this will be charged to the buyer.

6. Complaints

– Take photos of the damage, both with and without the packaging.
–Send the photo, order number, and a detailed description of the complaint by email to: melinda@svenskabadtunnor.se

– We will agree on whether the product should be returned to us or whether the issue will be resolved on site.
–You are responsible for dismantling the product, packing it, and sending it to us.

– Any transport damage during return shipping will be covered by the customer if it is not approved by the carrier.
– If the damage is covered by the warranty, you will receive a warranty approval and reimbursement of the shipping costs.

– We will repair the item or send you a new one.

– You are responsible for installing the new or repaired item. We do not cover installation costs.

– The item will be replaced or refunded once the return has been approved.
– If you suspect a defect with the product, it is important that you do not disassemble it or attempt to repair the issue before contacting us, as the warranty will not apply if this is done. We cover return shipping for approved complaints. We reserve the right to reject a complaint if it turns out that the item is not defective in accordance with applicable consumer protection legislation. 7. Limitation of Liability

– We do not accept liability for indirect or direct damages that may arise from the product. We also do not accept liability for damage to the surrounding environment that may be caused by product defects or damage. We do not assume responsibility for delays or errors due to circumstances beyond the company’s control (force majeure). Such circumstances may include, for example, labor disputes, fire, war, government decisions, or reduced or failed deliveries from suppliers. Furthermore, we do not accept liability for any changes to products or product characteristics made by respective suppliers or other factors beyond our control. Swedish Hot Tubs can never be held liable for indirect damages such as operational downtime, loss of profit or revenue, or other indirect losses, regardless of whether the buyer has been negligent or not.

8. Product Information
– We reserve the right for any typographical errors on this website as well as out-of-stock products. We do not guarantee that the images accurately reflect the exact appearance of the products, as color variations may occur depending on screen settings, image quality, and resolution. We always strive to present the products as accurately as possible.

9. Information about cookies

– In accordance with the Electronic Communications Act, visitors to a website must, for privacy reasons, be informed that cookies are used. The information in cookies may be used to track a user’s browsing activity. A cookie is a small text file that the website you visit requests to store on your computer in order to provide access to various functions. 10. Personal Data

– By shopping with Svenska Badtunnor AB, you accept our privacy policy and our processing of your personal data. We protect your privacy and do not collect more information than necessary to process your order. We never sell or share your information with third parties without a legal basis. Svenska Badtunnor AB is responsible for the processing of personal data that you have provided to us as a customer. Your personal data is processed by us in order to manage your order, and in cases where you have requested newsletters or promotional offers, to tailor marketing to your individual needs. Below you will find a summary of how we, in accordance with the General Data Protection Regulation (GDPR), store and process your information.


10.1 What is personal data?
– Personal data is any information that can be directly or indirectly linked to a natural person.
10.2 What information do we store?
– In order to process your order and respond to questions related to your order (customer service), we store your personal identification number, first and last name, address, phone number, email address, IP address, and purchase history. Your information is stored for as long as we have a legal basis to process it, for example to fulfill the agreement between us or to comply with a legal obligation, such as accounting legislation.
10.3 Legal basis
– In connection with a purchase, your personal data is processed in order to fulfill the agreement with you. Marketing, promotions, and similar communications are carried out with your consent.
10.4 What information is shared and for what purpose?
10.4.1 Payment provider
– When completing a purchase, information is shared with our payment provider. The information stored includes first name, last name, address, email address, and phone number. If you choose to pay by invoice, your personal identification number is also stored by the payment provider. The information is stored in order to complete the purchase and to protect the parties against fraud. The payment providers (payment services) we use are: invoice, Swish, as well as instalment payments and invoice via Svea Ekonomi.

10.4.2 Shipping company

– In order to deliver your orders and fulfill our agreement, we need to share certain information with the shipping company. The information shared includes first name, last name, and delivery address details. Email address and/or mobile number may also be shared with the shipping company for notification purposes. The shipping company we cooperate with is DB Schenker.

10.4.3 Newsletter

– If you have chosen to subscribe to our newsletter, your first name, last name, and email address are shared with our newsletter provider. This is done in order to keep you updated with information and offers for marketing purposes. We use a newsletter provider to send out newsletters.
10.5 Right of access

– You have the right to access all information we hold about you. Extracts are provided electronically in a readable format.

10.6 Right to rectification

– You have the right to ask us to update incorrect information or to complete information that is incomplete.
10.7 Right to be forgotten
– You may request at any time that the information relating to you be deleted. There are a few exceptions to the right to erasure, for example if the information must be retained to comply with a legal obligation (such as accounting legislation).

10.8 Data protection officer

Svenska Badtunnor AB is responsible for the storage and processing of personal data in the online store and ensures that the regulations are complied with.

10.9 How we protect your personal data
– We use industry standards such as SSL/TLS and one-way hash algorithms to store, process, and communicate sensitive information such as personal data and passwords in a secure manner. We use a Swedish platform, Askås, which is operated by Askås with its headquarters in Säffle.

11.Changes to the General Terms and Conditions
–We reserve the right to make changes to the terms at any time. Changes to the terms will be published on the website. The updated terms are considered accepted in connection with placing an order or visiting the website.

12. Disputes and governing law
–If a dispute cannot be resolved in agreement between the company’s customer service and the customer, you as a customer may contact Allmänna Reklamationsnämnden, see arn.se. For customers residing in another EU country than Sweden, you may submit a complaint via the European Commission’s online dispute resolution platform, see https://ec.europa.eu/consumers/odr In the event of a dispute, we follow decisions from Allmänna Reklamationsnämnden or an equivalent dispute resolution body. Disputes concerning the interpretation or application of these general terms shall be interpreted in accordance with Swedish law.

13. Our warranties
– Consumer legislation gives you a one-year warranty and a three-year right to make a complaint for any manufacturing defects.
– Thanks to the fact that we manufacture the hot tubs ourselves, we know they are durable, provided they are used correctly and not affected by external factors. Therefore, we can offer significantly more generous warranties:

* Three-year warranty on polyethylene plastic inserts

* Two-year warranty on heaters
*One-year warranty on wear parts such as lighting, gaskets, and seals

The warranties are valid provided that you follow our installation manuals and maintenance instructions. Keep your invoice or delivery note—both serve as proof of warranty. You must always contact us for approval before returning a defective item. Complaints must be submitted immediately after the defect is discovered. The warranty becomes void if any modifications are made to the product without prior approval from Svenska Badtunnor. The warranty also does not apply if repairs have been carried out using non-approved spare parts or if maintenance has not been performed in accordance with the instructions.

– No warranties apply in the following cases:

* Use of chlorine in the hot tubs (chlorine is approved for use in our electrically heated terrace pools with plastic connections; it must be chlorine intended for hot tubs, and we do not accept responsibility for damage that may occur due to overdosing or incorrect use of chlorine)

*Damage caused by incorrect water quality

* The electrical system must have sufficient insulation. The temperature in the technical compartment must be 10°C or higher. The temperature in the technical compartment must not differ by more than a couple of degrees from the water temperature. Hoses running outside the technical compartment to and from the hot tub must have at least the same level of insulation as the rest of the system.

* Use of disinfectants other than Biocool in hot tubs with a wood-fired heater or gas heater, as well as if you have connections in the tub that are made of aluminum.

* In case of ice formation in the hot tub
*Firing the heater without the hot tub being sufficiently filled with water
*Damage that occurs to a product as a result of water freezing in or on it.

* Running the pump dry

*Water in any of the electrical components

*If the hot tub is emptied before the heater has cooled down

14. Transport damage

It is the buyer’s responsibility to inspect the goods upon receipt. If the buyer discovers that the shipment has been damaged during transport, this must be reported immediately to the pickup point or the carrier on site. The damage must then be described in the transport document, which must be signed by both parties. After that, send an email to info@svenskabadtunnor.se with photos and a description of what has happened.

All remarks regarding the delivery must be reported to us within seven days after delivery. Errors reported after this will not be compensated by us at Svenska Badtunnor or by the carrier.

By signing the transport document provided by the carrier, you as the buyer confirm that the delivery has been accepted and that there is no damage to the goods. If transport damage is discovered after receipt and the delivery has been approved by your signature as the buyer, there is no right to compensation from Svenska Badtunnor or the carrier.

15. Right of withdrawal

– All hot tubs are always custom-made to suit the customer. Despite this, we offer a 14-day right of withdrawal after delivery.

15.1 When exercising the right of withdrawal: You must notify us that you wish to withdraw. The message must be sent to us at info@svenskabadtunnor.se. The message must clearly include your name, address, email address, order number, and which items the return concerns. You must return the products to us immediately and no later than 14 days after notifying us of your withdrawal. You are responsible for the return shipping, delivery, and the condition of the products upon return. The products should therefore be sent well packaged and in their original packaging. The buyer bears the cost of return shipping. We reserve the right to deduct an amount corresponding to the depreciation in value compared to the product’s original value if the product has been used or damaged. A deduction of 3000 SEK will be made from the refund if we have arranged the shipping of the hot tub to you. For hot tubs shipped outside Sweden, this amount may be higher. If transport by crane truck has been used, a higher amount will also be deducted if this transport has not been paid for by the customer.

15.2 In cases where the product has been manufactured according to the buyer’s specific requirements, no right of withdrawal applies. The right of withdrawal is entirely void if the product has been used beyond what is objectively reasonable to examine it and/or determine its characteristics. Such use may include, for example, that it has been installed, filled with water, or heated, etc.

15.3 The right of withdrawal applies only to private individuals purchasing the product for personal use. For businesses, or if the purchase is considered to be made for use in commercial activities, no right of withdrawal applies.

16. In accordance with the terms of this purchase agreement, Svenska Badtunnor disclaims all liability for any direct or indirect damage to persons, property, or finances that may arise as a result of its products or services, or as a result of the buyer’s inability to use these products or services.

The buyer agrees to indemnify Svenska Badtunnor and its employees, owners, and representatives against all claims, losses, liabilities, and expenses that may arise in connection with the buyer’s use of products and services, including products and services received through the buyer’s use of Svenska Badtunnor’s products and services. The buyer shall also indemnify Svenska Badtunnor against any claims, losses, liabilities, and expenses that may arise as a result of the buyer’s breach of any of the terms of this agreement, the buyer’s use of personal data, or the buyer’s infringement of third-party rights, including external suppliers.

By entering into this purchase agreement, the buyer agrees that Svenska Badtunnor shall not be held liable for any damages, losses, liabilities, or expenses that may arise as a result of the buyer’s use of products and services, or if the buyer breaches any of the terms of this agreement.
